Family law regulates the legal relationships of family members with each other and with third parties. Among other things, marital and partnership property law, alimony and pension equalization after divorce or dissolution of a partnership play a major role in family law. In view of the complex legal issues that regularly arise in connection with a marriage or a civil partnership, it is advisable to seek qualified legal advice before entering into a marriage or a civil partnership.
But even if a divorce is pending, it is still possible to settle the subsequent matters such as pension equalization, spousal and child support, custody and access rights, marital home and household matters as well as the equalization of gains by mutual agreement in order to reduce the costs of the divorce proceedings. But here, too, it is advisable to seek legal advice as early as possible.
Special legal questions arise in particular in the case of binational marriages, marriages and divorces of non-German nationals in Germany, etc. Here, taking into account the complicated system of international private law, the question of the applicable law should be clarified with legal advice at the latest at the time of separation or before filing the divorce petition and - as far as possible - a choice of law should be made.
